Acceptance of Terms

By using PelaSync, you agree to be bound by these Terms of Service. PelaSync is operated by PelaSync. If you do not agree to these terms, do not use the service.

Service Description

PelaSync is an SMS-based journaling platform. Clients send text messages containing journal entries, which are securely stored and made accessible to their associated provider(s) via generated reports.

SMS Messaging Terms

By opting in to PelaSync, you agree to receive and send SMS messages through our service. You may opt in by completing the online Enrollment Page, either via a provider-supplied enrollment link or through open enrollment. Key terms:

• Message frequency varies based on your usage
• Message and data rates may apply
• Reply STOP at any time to opt out
• Reply HELP for assistance
• Consent is not a condition of receiving care
• Carriers are not liable for delayed or undelivered messages

Consent and Enrollment

Clients enroll in PelaSync through the online Enrollment Page. Explicit consent must be provided during enrollment before any journal entries can be collected. Clients may enroll in one of two ways:

• Provider-linked enrollment: Using an enrollment link supplied by your provider, which pre-associates your account with that provider.
• Open enrollment: Completing the enrollment form without a provider code.

In both cases, the form includes the following disclosure directly above the opt-in checkbox: "By checking this box, you agree to receive SMS messages related to journaling from PelaSync. Message and data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help. Consent is not a condition of receiving care." The checkbox is unchecked by default and must be actively selected by the client. Providers do not complete opt-in on behalf of clients. Consent may be revoked at any time by texting STOP, and re-enrollment is available through the same online Enrollment Page.

Data Handling

Your data is handled in accordance with our Privacy Policy. All message content is encrypted at rest. Entries are retained for as long as you remain enrolled with your provider and are deleted when your provider removes you from the platform or upon written request.

Calendar Integration (Practitioners)

Practitioners may optionally connect a Google Calendar account to PelaSync. This connection is not required to use the service, is available only to practitioners, and is never offered to clients. By connecting an account, the practitioner confirms that they are authorized to grant access to it and to have appointments written to it.

• PelaSync reads only free/busy time ranges from the connected calendar, and writes a de-identified event for each booked appointment. Details are described in our Privacy Policy.
• A practitioner may disconnect at any time from the Settings page, which revokes PelaSync's access and deletes the stored authorization token.
• Use of Google Calendar remains subject to the practitioner's own agreement with Google. Practitioners subject to HIPAA are responsible for their own arrangements with Google, including any Business Associate Agreement covering calendar data.

User Responsibilities

• Not for emergencies: PelaSync is not an emergency service. If you are experiencing a medical emergency, call 911 immediately.
• One-way journaling: Providers cannot respond to your journal entries via SMS. For scheduling, billing, or clinical questions, contact your provider's office directly.
• You are responsible for the accuracy of the information you submit.

Limitations of Liability

The service is provided "as is" without warranties of any kind, express or implied. PelaSync is not liable for:

• SMS delivery failures or delays caused by carriers or network issues
• Clinical decisions made based on journal entry content
• Loss of data beyond what is covered by our backup policies
• Service interruptions or downtime

Termination

Either party may terminate use of the service at any time. Clients may opt out by texting STOP. Providers may remove clients from the platform. We reserve the right to suspend or terminate accounts that violate these terms.

Changes to These Terms

We may update these Terms of Service from time to time. Changes will take effect upon posting to this page. Continued use of the service constitutes acceptance of the updated terms.
